Shariat law
Shariat Law also known as Muslim Personal law is broadly derived from the Quran to designate the rules and regulations governing the lives of Muslims.
All India Muslim Personal Board
It was constituted in 1973 to adopt strategies for protecting Shariat pronouncements in India. This private body has 41 Ulema working committee members . Its general body has 201 members which also include women.
Shariat law Issues
This law pertains to all cases of disputes among Muslims except agricultural land. It comprises succession, specific propery of females, marriage , divorce, maintenance, dowery, guardianship, gifts, trusts and their properties.
Fatwa
It is a legal pronouncement made by a Shariat scholar . It is generally issued by Islamic Institutions ab initio or at the request of an individual to settle a question of Islamic jurisprudence.
Shariat law Challenged
As Shariat rulings represent a parallel judicial system , it was challenged. However the Central Government and All India Muslim Personal Board contend that the rulings of Shariat Courts are only advisory in nature and do not affront the soverignty of the Constitution.
Recent Controversial Shariat Court Rulings
Shariat Court as recently as in 2006 sentenced to death a Danish cartoonist who had caricatured Prophet Mohammed. The judgment was pronounced after the Minister of Haj and Religious Minorities of Uttar Pradesh , Shri Yakub Qureshi, declared a reward of $11.5 million for the head of the cartoonist.
In 2005, the Shariat Court refused to take any action against Ali Mohammed after he raped his daughter- in- law Imrana and threatened to kill her. The court ruled that Noor Ilahi had ceased to be her husband and should then onwards be treated like her son.
